GitCode platform (hereinafter referred to as "this platform") is operated by Chongqing Open Source Co-Creation Technology Co., Ltd. (hereinafter referred to as "GitCode" or "we"). This privacy policy applies to the services provided by this platform and does not involve any third-party services. This privacy policy only applies to our processing of your personal information when you use the services provided by this platform, and does not apply to our processing or custody of your personal information as an agent on this platform. I. Definitions

(1) Personal Information: refers to various information recorded in electronic or other forms related to identified or identifiable natural persons, excluding information that has been anonymized.

(2) Sensitive Personal Information: refers to personal information that, once disclosed or illegally used, is likely to cause harm to the personality dignity of natural persons or their personal safety and property, including biometric identification, religious beliefs, specific identities, medical health, financial accounts, movement trajectory information, and personal information of minors under the age of fourteen.

(3) Personal Information Processing: includes the collection, storage, use, processing, transmission, provision, public disclosure, and deletion of personal information.

The definitions of other concepts not mentioned in this privacy policy are consistent with those in relevant laws and regulations of the People's Republic of China.

II. How We Collect and Use Your Personal Information

(I) Account Registration

When you complete the registration process on GitCode, we may need you to provide your phone number, username, and for the sake of account security, you may also need to set up an account password. If you refuse to provide the above information, you will not be able to register a GitCode account, and you can only use browsing and search services.

(II) Third-Party Account Login Function

In addition to registering an account on this platform, when you log in to this platform via a third-party platform account, you need to authorize us to collect the nickname, avatar, username, phone number, and email address of the third-party platform account. You understand that, based on the requirement for providing information services under real-name system, the aforementioned information is necessary personal information for logging in to this platform via a third-party platform account. If you cannot provide the aforementioned information, you will not be able to log in via a third-party platform account. The aforementioned information is collected only when you first use a third-party platform account to log in.

(III) Personal Profile Display

This platform provides a personal profile editing function. You can enrich and improve your personal profile through the editing function. For this purpose, we will collect your user nickname, avatar, email address, Github account, personal website, company, location, and personal introduction information. The above information will be collected every time you edit your personal profile. You understand that the above personal information is voluntarily provided by you. If you cannot provide the aforementioned information, it will not affect your use of other functions of this platform except for personal profile editing and display. Please note that your personal profile information may be displayed to other users of this platform.

(IV) SSH Public Key Creation

SSH public keys are used to establish a more secure connection between your computer and this platform. This platform can generate an SSH public key for this purpose. The SSH public key and its name are set up by you actively. The above personal information is voluntarily provided by you. If you cannot provide the aforementioned information, it will not affect your use of other functions of this platform except for the SSH public key creation function.

(V) Information Obtained from Third Parties

Under the law, based on your authorization, to provide you with more optimized services and meet your personalized needs, we may receive your personal information or other information from our affiliated companies or partners. In addition, we will also collect the shared personal information provided by others when they use our products or services.

In the above scenarios, sensitive personal information such as your ID documents, detailed address, and payment information (bank account, bank transaction number) may be collected. The purposes of collecting this information include complying with the requirements of relevant laws and regulations for online real-name authentication, verifying your user identity, and fulfilling the contract with you. For example, providing consulting or technical support, issuing invoices, and sending goods.

(VI) We May Use Your Personal Information for the Following Purposes:

  1. We use your registration information to create your account and provide you with services.

  2. We use your user personal information, especially your username, to identify your identity on the GitCode website.

  3. We use your personal information to fill in your account profile and share it with other users as per your request.

  4. We use your email address or other contact information to contact you. To provide you with services, we may send you messages, notifications, or communicate with you for business purposes, including but not limited to verification codes necessary for completing the service, push notifications necessary for using the service. We may design, develop, and promote new products and services based on personal information statistics. We may statistically analyze the usage of our services and may share these statistical information with the public or third parties, but these statistical information does not contain any of your identity information.

  5. We use necessary user personal information to respond to technical and other support requests. When you contact our customer service, we may need you to provide necessary information to match and verify your identity to ensure the security of your account and system. We may also keep your contact information (the contact information you use when contacting us or other contact information you proactively provide, such as: mobile phone number, email address), your communication/phone records and content, and other necessary information related to your needs, so that we can contact you or help you solve problems, or record the solution and results of the relevant issues.

  6. You can post your technical views on this platform and interact with other users. To provide you with these services, we will collect the information you upload, publish, or form (which may include images, text, article comments you upload), and have the right to display your username, nickname, avatar, and published content.

  7. When you choose to participate in events, competitions we hold, or claim related rewards, we may collect your necessary information, at which time we will inform you of the relevant information collection purpose and obtain your authorization.

  8. To enhance the security of the services we and our partners provide, protect your or other users' or the public's personal property safety from being harmed, better prevent phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, network intrusions, and other security risks, accurately identify situations that violate laws and regulations or the platform's service-related agreements, rules, we may collect, use, or integrate your account information, log information, and information already authorized or legally shared to comprehensively assess your account and transaction risks, perform identity verification, detect and prevent security incidents, and legally take necessary recording, audit, analysis, and handling measures.

We may periodically send you activity invitations or product service experience promotions via SMS, email, in-site messages, or phone calls, or recommend projects that you may want to follow or contribute to. At that time, we will complete the above services using the contact information you provided during registration. If you do not wish to receive this service, you can unsubscribe or withdraw your consent through the method shown in "VIII. (IV) Withdraw Consent" of this privacy policy. After you unsubscribe or withdraw, we will no longer provide you with this service.

  10. We may use your usage information and device information on this platform to better understand how you use the platform services to improve the platform services.

  11. For security purposes, or to investigate possible fraudulent activities or attempts to harm us or our users, we may use your user personal information.

  12. We may use your user personal information to fulfill our legal obligations, protect our intellectual property, and enforce our service terms.

When we provide you with functions or specific services, we will collect, use, store, provide, and protect your personal information according to this privacy policy and the corresponding service agreement; if we collect your personal information beyond the scope of this privacy policy and the corresponding service agreement, we will explain the scope and purpose of the information collection separately and collect the necessary information for the service after obtaining your consent. If you choose not to provide the aforementioned information, it will affect your use of the corresponding specific functions or services.

You fully understand that, according to applicable laws, in the following circumstances, we do not need to obtain your authorization and consent to collect and use your personal information:

  1. Necessary for concluding and performing a contract where you are a party;

(IX) Device Information and Log Information

  1. In order to ensure the security of software services and your account, the quality and efficiency of service operations, we will collect your device information (including IMEI, device serial number, OAID, MEID, Android ID, IMSI, GUID, MAC address, SIM card serial number), SN, hardware model, operating system version number, device name, device configuration, clipboard information, international mobile equipment identification code, unique device identifier, network device hardware address, IP address, WLAN access point, Bluetooth, software version number, network access method, type, status, network quality data, operation, use, service logs. We may associate your device information or phone number with your account;

  2. In order to prevent malicious programs, ensure service security, and improve the browsing experience, we will collect the information of installed applications or running processes, application overall operation, usage situation and frequency, application crash situations, overall installation and usage situation, performance data, application sources;

  3. We may use your account information, device information, service log information, and information obtained from our affiliated companies or partners with your authorization or according to law, to determine account security, application launch activity and activity, perform identity verification, detect and prevent security incidents.

(X) Data Synchronization and Account Integration

To achieve the business integration of this platform and AtomGit, provide a unified account system and service experience, after obtaining your separate consent, we need to synchronize and process your personal information between this platform and AtomGit.

  1. We may need to synchronize all your personal information on this platform (including but not limited to user nickname, account ID, avatar, username, email, phone number, etc.) to AtomGit; we may also accept and process your personal information from AtomGit (including but not limited to user nickname, avatar, username, email, phone number, etc.).

  2. After the integration, your operation (such as creating, modifying, deleting) of personal information (including but not limited to user nickname, account ID, avatar, username, email, phone number) on either platform may be synchronized and updated on the other platform.

  3. If the system detects that you have accounts on both this platform and AtomGit with the same phone number/email, to ensure the uniqueness of the account, after your consent, we will merge the two accounts according to the rules clearly stated during the integration process. At the same time, when the usernames on the two platforms are inconsistent, we will use the username on this platform. The account merging may be irreversible, so please read the relevant rules carefully before agreeing.

  4. Legal basis and your rights: This data synchronization and integration fall under the category of changing the purpose of personal information use as stipulated in the Personal Information Protection Law. Therefore, we will inform you clearly through pop-up windows / announcements before implementation and obtain your separate consent. You have the right to refuse this synchronization and integration. If you refuse, you will not be able to experience the integrated unified service.

III. How We Share, Entrust Processing, Transfer, and Publicly Disclose Your Personal Information

(I) Sharing

In principle, we will not share your personal information with other organizations and individuals, except in the following cases:

  1. Sharing with your explicit consent: After informing you of the name or name of the third party, contact information, processing purpose, processing method, and type of personal information, and obtaining your explicit consent, we will share the information within the scope of your authorization with the third party you agree to.

  4. Sharing for the necessity of concluding and performing a contract where you are a party

We may share your personal information with our affiliated companies, and your personal information may be shared among our affiliated companies. We will only share necessary personal information, and such sharing is subject to the constraints of this privacy policy. If an affiliated company wishes to change the purpose of processing personal information, it will seek your authorization again. Moreover, before providing the information to the affiliated company, we will make every commercial effort to assess the legality, propriety, and necessity of the information collected by the affiliated company. However, we will only share your information for legitimate, proper, necessary, specific, and clear purposes, and only share the information necessary for providing the service. (II) Entrusted Processing

We may entrust authorized partners to process your personal information, so that the authorized partners can provide certain services or perform functions on our behalf. We will only entrust them to process your information for legitimate, proper, necessary, specific, and clear purposes as stated in this policy, and the authorized partners will only have access to the information required to perform their duties. We will require them through agreements not to use this information for any purposes beyond the scope of the entrustment. If the authorized partner uses your information for purposes not entrusted by us, they will seek your consent individually. The authorized partners we entrust include the following types:

Code Hosting Service: Based on the need to provide code hosting services, we will entrust a cloud service technology provider to provide code hosting services, process, store, or host your content ("your content" refers to all information (including personal information), code, software, devices, text, images, videos, audio, photos, third-party applications, materials) that you transmit, store, or process while using this service. The cloud service technology provider will only provide code hosting services within the scope of the commission received from this platform and under the instructions of this platform. We will sign a strict data processing agreement or confidentiality agreement with Huawei Cloud to require them to handle personal information according to our instructions, this privacy policy, and any other relevant confidentiality and security measures, ensuring that they will not actively access or access the personal information and any other data generated by you when using this platform.

  2. Content Review Service: In order to meet the legal requirements of this platform for internet information content security and account information management, we may entrust one or more information content review technology service providers to assist us in fulfilling our legal obligations for platform content governance. We will sign a strict data processing agreement or confidentiality agreement with the entrusted content review technology service provider. You understand that during the aforementioned review process, it may involve reviewing and processing the information content you submit, upload, or publicize through various forms such as machines or humans. However, we will take necessary de-identification measures to ensure information security and have these content review technology providers process the data.

  3. Customer Service: To promptly handle your complaints, suggestions, and other requests, we may entrust one or more customer service providers to process your relevant personal information, so that we can promptly understand, process, and respond to your needs. We will sign a strict data processing agreement or confidentiality agreement with the customer service provider. You understand that during the aforementioned customer complaint resolution process, your account information, your complaints, suggestions, or other requests may be collected and used, and if necessary, we may feedback the customer complaint resolution results to you through your reserved phone number or other communication methods on the platform.

  4. Other product or service suppliers and other partners: We will entrust suppliers and other partners who support our business to process personal information. These supports include professional services such as consulting, analysis, marketing, and technical support provided by us.

(III) Transfer

We will not transfer your personal information to any company, organization, or individual, except in the following cases:

  1. Transfer with your explicit consent: After obtaining your explicit consent, we will transfer your personal information to other parties;

  2. In the event of merger, acquisition, asset transfer, bankruptcy liquidation, or other similar situations, if personal information transfer is involved, we will require the new company or organization holding your personal information to continue to be bound by this privacy policy.
