One, Definitions

(1) Personal Information: Any information recorded in electronic or other forms related to an identified or identifiable natural person, excluding anonymized information.

(2) Sensitive Personal Information: Personal information that, if leaked or illegally used, could easily lead to harm to a natural person's dignity or personal and property safety. This includes biometric data, religious beliefs, specific identities, medical health, financial accounts, location tracking information, as well as personal information of minors under fourteen years old.

(3) Processing of Personal Information: Includes collecting, storing, using, processing, transmitting, providing, publicly disclosing, deleting, etc., of personal information.

Definitions of other concepts not mentioned in this privacy policy are consistent with those defined in relevant Chinese laws and regulations.

Two, How We Collect and Use Your Personal Information

(1) Account Registration

When you complete the registration process on the GitCode website (https://www.gitcode.com), we may need you to provide your phone number and username. To ensure account security, you may also need to set a password. If you refuse to provide this information, you will not be able to register a GitCode account and can only use browsing and search services.

(2) Third-Party Account Login Function

In addition to registering an account on this platform, when you log in using a third-party platform account, you need to authorize us to collect the nickname, profile picture, username, phone number, and email address associated with the third-party platform account. You understand that, based on the platform's real-name authentication requirement for information services, the aforementioned information is necessary to enable login via a third-party platform account. These details will only be collected during your first login with a third-party platform account.

(3) Display of Personal Profile

This platform provides a personal profile editing feature, allowing you to enrich and improve your profile. For this purpose, we will collect the user nickname, profile picture, email address, GitHub account, personal website, company, location, and personal description you provide. The above information will be collected each time you edit your personal profile. You understand that the above personal information is provided voluntarily by you. If you cannot provide the aforementioned information, it will not affect your use of other functions of the platform except for personal profile editing and display. Please note that your personal profile information may be displayed to other users on the platform.

(4) Creation of SSH Public Key

An SSH public key is used to establish a more secure connection between your computer and this platform. This platform can generate an SSH public key for you. The SSH public key and its name are set up by you voluntarily. The above personal information is provided voluntarily by you. If you cannot provide the aforementioned information, it will not affect your use of other functions of the platform except for the SSH public key creation function.

(5) Obtaining Information from Third Parties

Within legal limits and with your authorization, to provide you with optimized services and meet your personalized needs, we may receive your personal information or other information from our affiliates or partners. Additionally, we may collect shared personal information from third parties who use our products or services.

In the above scenarios, sensitive personal information such as your ID documents, detailed addresses, payment information (bank account, bank transaction number) may be involved. The purposes of collecting such information include meeting relevant legal requirements for online identity verification, verifying your user identity, and fulfilling contractual obligations with you, such as providing consulting or technical support, issuing invoices, and delivering goods.

(6) Purposes for Which We May Use Your Personal Information

  1. We use your registration information to create your account and provide services.

  2. We use your user personal information, especially your username, to identify you on the GitCode website.

  3. We use your personal profile information to fill out your account profile and share it with other users according to your request.

  4. We use your email address or other contact methods to communicate with you. To provide services, we will send you messages, notifications, or conduct business communications, including but not limited to verification codes necessary to complete services and push notifications required for service usage. We may base product and service development on personal information statistics; we will statistically analyze our service usage and may share these statistics with the public or third parties, but these statistics do not contain any identity-related information.

  5. We use necessary user personal information to respond to technical and other support requests. When you contact our customer service, we may need to provide necessary information to match and verify your identity to ensure the security of your account and system. We may also save your contact information (the contact information you use when communicating with us or proactively provide to us, such as: phone number, email address), communication/phone records and contents, and other necessary information related to your request to contact you or help resolve your issues, or record the handling solutions and results.

  6. You can publish your technical views and interact with other users on this platform. To provide such services, we will collect the information you upload, post, or generate (which may include images, text, article comments you upload) and have the right to display your username, nickname, profile picture, and posted content.

  7. When you choose to participate in events, competitions, or claim rewards we organize, we may collect necessary information at that time. We will inform you separately about the purpose of collecting and using this information and obtain your authorization.

  8. To enhance the security of the services provided by us and our partners, to protect the personal and property safety of you or other users or the public from infringement, and to better prevent phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, and network intrusions, and more accurately identify violations of laws and regulations or platform service agreements and rules, we may collect, use, or integrate your account information, log information, and information obtained with your authorization or in accordance with the law to comprehensively judge your account and transaction risks, perform identity verification, detect and prevent security incidents, and take necessary recording, auditing, analysis, and disposal measures in accordance with the law.

  9. We may periodically send you activity invitations, product service experience promotion content, or recommend projects you may want to follow or contribute to via SMS, email, internal messages, or phone. We will complete these services using the contact information you provided when registering. If you do not wish to receive this service, you can unsubscribe or withdraw your consent through the "Eight, (Four) Withdrawal of Consent" section in this privacy policy. After unsubscribing or withdrawing, we will no longer provide this service to you.

  10. We may use your usage information and device information on this platform to better understand how you use the platform's services and improve them.

  11. For security reasons, or to investigate possible fraudulent behavior or attempts to damage us or our users, we may use your user personal information.

  12. We may use your user personal information to fulfill our legal obligations, protect our intellectual property rights, and enforce our service terms.

When we provide you with functions or specific services, we will collect, use, store, disclose, and protect your personal information in accordance with this privacy policy and the corresponding service agreement. If we collect your personal information beyond what is specified in this privacy policy and the corresponding service agreement, we will explain the scope and purpose of information collection separately and obtain your consent before collecting the necessary information to provide the corresponding service. If you choose not to provide the aforementioned information, it will affect your use of the corresponding specific function or service.

You fully understand that, in accordance with applicable laws, we do not need to seek your authorization and consent to collect and use your personal information in the following situations:

  1. It is necessary to enter into and perform a contract to which you are a party;

  2. It is necessary to fulfill the statutory obligations of this platform;

  3. In case of sudden public health emergencies, or in emergency situations to protect the life, health, and property safety of natural persons;

  4. Conducting news reporting, public opinion supervision, and other actions in the public interest within reasonable limits;

  5. Processing information that has been made public by yourself or that has been legally disclosed in accordance with the law within reasonable limits;

  6. Other circumstances stipulated by laws and administrative regulations.

Three, How We Share, Entrust Process, Transfer, and Publicly Disclose Your Personal Information

(1) Sharing

In principle, we share your personal information with other organizations and individuals, except in the following cases:

  1. Sharing with Explicit Consent: When you are informed of the name or name, contact information, purpose, method, and types of personal information of the third party, and we obtain your explicit consent, we will share the information within the scope of your authorization with the agreed third party.

  2. Sharing Under Legal Circumstances: We may share your personal information with external parties in accordance with legal provisions, litigation dispute resolution needs, or at the request of administrative or judicial authorities.

  4. Sharing Between Affiliated Companies

We may share your personal information with our affiliated companies, and your personal information may be shared among our affiliated companies. We will only share necessary personal information, and such sharing is subject to this privacy policy. If an affiliated company changes the purpose of processing personal information, they will seek your reauthorization. Before providing information to an affiliated company, we will make every reasonable effort to assess the legality, propriety, and necessity of the information collected by the affiliated company. We will strive to require our affiliated companies to take protective measures for your information.

  1. Sharing with Business Partners to Provide Services

We may share your personal information with third-party partners such as business partners to ensure the smooth completion of the services provided to you. However, we will only share the minimum necessary information for legitimate, proper, necessary, specific, and clear purposes. To protect your personal information and privacy, we will specify in agreements the responsibilities, obligations, and requirements for protecting your personal information by the partner. The partner may have its own privacy policy and user agreement, and we recommend that you read and comply with the third-party user agreement and privacy policy. Our partners include:

(1) Huawei Cloud: To use the services of this platform, when you register or log in to the platform, before using the code hosting service provided by the platform, you need to authorize and activate the Huawei Cloud service provided by Huawei Cloud Computing Technology Co., Ltd. ("Huawei Cloud"). With your separate consent, we will provide your phone number and username to Huawei Cloud.

(2) Other Third-Party Partners: To complete service delivery or after-sales service, we may share your personal information with third-party partners supporting the aforementioned functions of the platform, including third parties supplying goods or providing infrastructure technology services and data processing services.

(2) Entrusting Processing

We may entrust authorized partners to process your personal information so that they can represent us in providing certain services or performing functions. We will only entrust them for legitimate, proper, necessary, specific, and clear purposes stated in this policy. The authorized partners will only have access to the information necessary for their duties, and we will require them through agreements to not use this information for any purposes beyond the scope of the entrusted tasks. If an authorized partner uses your information for purposes other than what we have entrusted, they will seek your separate consent. The types of authorized partners we entrust include the following:

  1. Code Hosting Service: Based on the need to provide code hosting services, we may entrust a cloud service technology provider to handle, store, or host your content ("your content" refers to all information, including personal information, code, software, devices, text, images, videos, audio, photos, third-party applications, materials, that you transmit, store, or process in any format while using this service). The cloud service technology provider will only provide code hosting services within the scope of the platform’s commission and under the platform’s instructions. We will require them through strict data processing agreements or confidentiality agreements signed with Huawei Cloud to handle personal information in accordance with our instructions, this privacy policy, and any other relevant confidentiality and security measures to ensure they do not actively access or obtain your personal information or any other data generated when using the platform.

  2. Content Review Service: To meet the statutory requirements for internet information content security and account information management on the platform, we may entrust one or more information content review service providers to assist us in fulfilling our legal obligations for platform content governance. We will sign strict data processing agreements or confidentiality agreements with the entrusted content review service providers. You understand that the review process may involve reviewing submitted, uploaded, or publicly disclosed information using various methods such as machine or human reviews, but we will take necessary desensitization measures to ensure information security, and these content review service providers will process the data.

  3. Customer Service: To promptly handle your complaints, suggestions, and other requests, we may entrust one or more customer service providers to process your related personal information so that we can promptly understand, handle, and respond to your needs. We will sign strict data processing agreements or confidentiality agreements with the customer service providers. You understand that the complaint resolution process may involve collecting and using your account information, voice or text records of your complaints, suggestions, or other requests, and contacting you by phone number or other communication methods reserved on the platform to provide feedback on the complaint resolution results when necessary.

  4. Suppliers and Other Partners Supporting Our Business: We entrust personal information to suppliers and other partners who process information to support our business, including professional services such as consulting, analysis, marketing, and technical support provided on our behalf.

(3) Transfer

We will not transfer your personal information to any company, organization, or individual, except in the following cases:

  1. Transfer with Clear Consent: After obtaining your clear consent, we will transfer your personal information to another party;

  2. Transfer in Case of Merger, Acquisition, Asset Transfer, Bankruptcy Liquidation, or Similar Situations: If the transfer involves personal information, we will require the new entity holding your personal information to continue to be bound by this privacy policy. Otherwise, we will require the entity to seek your reauthorization. In cases involving bankruptcy without a successor, we will delete the data in accordance with the law.

  3. Provide Information Required by Applicable Laws, Legal Procedures, Compulsory Administrative or Judicial Requirements

(4) Disclosure

We will only disclose your information under the following circumstances:

  2. In cases where laws, legal procedures, litigation, or public and government authorities require, we may publicly disclose your information.

  3. To protect the personal and property safety of this platform, us, and our affiliated companies’ users or the public from infringement, we may disclose your personal information in accordance with applicable laws or platform agreements and rules.

(5) Third-Party SDKs

While using the services of this platform, some services may require joint provision by us and third-party partners, such as social sharing. To achieve this, we integrate software development kits (SDKs) or similar applications from third-party partners. For more details, please refer to List of Third-Party SDKs.

According to relevant laws and regulations, or for the maintenance of public interests, we may share, publicly disclose, or transfer your personal information without seeking your consent in the following situations:

  1. Related to the fulfillment of our legal obligations;

  2. Directly related to national security and defense security;

  3. Directly related to public safety, public health, and major public interests;

  4. Directly related to criminal investigation, prosecution, trial, and judgment execution;

  5. To protect your or our employees’ lives, property, and other significant legal rights, but it is difficult to obtain your authorization;

  6. Personal information that the individual has voluntarily made public to the general public;

  7. Collecting personal information from legally public information sources, such as legal news reports and government information disclosure channels.

Four, How We Use Cookies and Similar Technologies

(1) What Are Cookies and Similar Technologies

Cookies are small files stored on your computer, mobile phone, or other smart terminal devices when you log in to a website or browse web content. They usually contain identifiers, site names, and some numbers and characters. We may use cookies to enhance your user experience and service friendliness when visiting this platform. Primarily, we use them for statistical and analytical purposes based on your website visit and usage habits, record your preferences and settings, and use this as a basis to improve our products and services. Besides cookies, similar technologies like web beacons or pixel tags can achieve similar effects through point reporting.

(2) How We Use Cookies and Similar Technologies

When you use this platform, we may collect your username, profile picture, device model, operating system, device identifier, and login IP address through cookies or similar technologies. Five, How We Respond to Your Requests for Personal Information Rights

(1) Querying, Correcting, and Supplementing Personal Information

You can query, correct, and supplement your personal information through [Personal Settings - User Profile].

(2) Deleting Personal Information

  1. You can delete your personal information through [Personal Settings - User Profile], or delete all information in your GitCode account by canceling your account, unless otherwise stipulated by laws, regulations, or industry regulatory rules.

  2. If you cannot independently delete information through the aforementioned methods, you can submit a request to delete your personal information to us through the "Nine, Contact Us" section in this privacy policy. We will normally process such requests within 15 days.

  3. After deleting the relevant information either by yourself or with our assistance, due to legal and security technical restrictions, we may not be able to immediately remove the information from our systems. We will securely store your personal information and restrict any further processing until it can be deleted or anonymized.

(3) Withdrawing Consent

You can change the scope of our continued collection of personal information or withdraw your authorization by deleting information or disabling features. You can also withdraw our continued collection of your personal information by canceling your account. However, your decision to withdraw consent or authorization will not affect the processing of your personal information based on prior authorizations.

Please understand that each business function requires some basic personal information to operate. After withdrawing consent or authorization, we will no longer be able to provide the corresponding services or process your personal information related to the withdrawn services.

(4) Account Cancellation

You can apply to cancel your account through the "Nine, Contact Us" section. After canceling your account, we will cease to provide services, and unless otherwise stipulated by laws, we will delete your personal information. After cancellation, the account cannot be restored. If you wish to enjoy the services again, you will need to re-register.

(5) How We Respond to Your Rights Requests

To ensure security, you may need to provide a written request or use other methods to prove your identity. We may first ask you to verify your identity before processing your request. Normally, we will respond within 15 days.

For reasonable requests, we generally do not charge fees. However, for repeated requests beyond reasonable limits, we may consider charging certain costs. For requests that are repetitive without reason, require excessive technical means (such as developing new systems or fundamentally changing current practices), pose risks to others' legal rights, or are impractical (such as involving information stored on backup tapes), we may refuse to respond.

Please be aware that, in the following circumstances, we will not be able to respond to your requests according to legal requirements:

(1) Directly related to national security and defense security;

(2) Directly related to public safety, public health, and major public interests;

(3) Directly related to criminal investigations, prosecutions, trials, and enforcement of judgments;

(4) There is substantial evidence indicating that you have malicious intentions or abuse your rights;

(5) Responding to your request would severely harm the legal rights and interests of you or other individuals or organizations.

(6) Involves trade secrets.

Six, How We Protect and Store Your Personal Information

(1) We value the security of your personal information. To protect your personal information, we take the following measures:

  1. We take reasonable and feasible measures to minimize the collection of personal information, ensuring that we do not collect information unrelated to the processing purpose;

  2. We use encryption technology to ensure the confidentiality of information transmission and storage. We use trusted protection mechanisms to prevent servers storing information from being maliciously attacked;

  3. We deploy access control mechanisms to ensure that only authorized personnel can access personal information; and control the number of authorized personnel according to business needs and hierarchical levels, implementing hierarchical permission management for authorized personnel;

  4. We carefully select business partners and service providers, incorporating requirements for personal information protection into contracts or audits, assessments, etc., with them;

  5. We hold safety and privacy protection training courses, tests, and promotional activities to enhance employees' awareness of the importance of protecting personal information.

(2) Although we are responsible for protecting your personal information, you also have the responsibility to properly manage your login information, including account IDs and passwords. If you discover that someone is using your account ID without your permission, please notify us immediately. You have the right to request us to suspend unauthorized use of your account.

(3) We will take reasonable and feasible measures to avoid collecting irrelevant personal information. We will strive to protect your personal information, but no measure is foolproof, and no service, product, website, information transmission, computer system, or network connection is absolutely secure.

(4) We will store your personal information collected or produced within China on servers located within China. In accordance with the requirements of relevant Chinese laws and regulations, such as the Personal Information Protection Law of the People's Republic of China, we limit the storage period of personal information to the minimum necessary range.

Seven, Protection of Minors' Personal Information

The website and its content, services are only intended for individuals aged fourteen and older.

Without the consent of parents or guardians, children under fourteen years old are not allowed to create their own user accounts. If we collect personal information of minors with parental consent, we will only use or disclose such information in compliance with legal requirements, with clear parental or guardian consent, or when necessary to protect minors. If we discover that we have collected personal information of minors under fourteen without prior verifiable parental or guardian consent, we will endeavor to delete the relevant personal information as soon as possible.
